Important

Customers remain responsible for their agreements, disclosures, lawful basis, and instructions. CarTrackKenya provides the service and records that support those instructions.

1. What we provide

CarTrackKenya provides vehicle tracking support, tools for managing payment agreements, payment reminders, payment records, owner dashboards, and, where the agreement allows it and the vehicle is correctly set up, starter-inhibit support.

The platform records payment confirmations, reminder messages, owner payouts, staff actions, and tracker commands.

2. Customers and vehicle users

Our customers are fleet owners, vehicle lessors, lenders, and businesses that manage vehicles under payment agreements.

A vehicle user may be the customer's borrower, lessee, person making payments, driver, or another authorized user. They may receive reminders or notices based on the agreement.

3. Customer obligations

Keep owner, contact, phone, ID, vehicle, and agreement details accurate.
Have a lawful basis for tracking, notifications, payment records, and data processing.
Disclose tracker use and any enforcement provisions before the agreement is signed.
Use enforcement only for payment default under the relevant agreement.

Starter-inhibit enforcement is governed by our published safeguards. Those safeguards form part of these terms.

5. Notifications and payment records

SMS and email delivery depends on mobile networks, internet services, and third-party providers. Delivery is not guaranteed.

Matching a payment depends on the correct M-Pesa account number, an active agreement, the details sent by M-Pesa, and accurate customer information.

6. Availability and integrations

We aim to provide reliable service, but we do not guarantee uninterrupted access to the platform, tracking services, mobile networks, M-Pesa services, email, SMS, or third-party integrations.

7. Accounts and security

Customers must keep account credentials secure and notify us immediately if they suspect unauthorized access or misuse.

8. Fees

Installation, hardware, subscription, support, and service fees are set out in the customer's service agreement or invoice.

9. Liability

We are not liable for failures caused by mobile networks, GPS coverage, internet availability, incorrect customer data, third-party providers, or instructions given by the customer.

The customer indemnifies us against claims arising from the customer's instructions, lack of lawful basis, inaccurate data, or failure to make required disclosures.
